Re: Request for Immediate Access to Public Records – Citadel Outlets Expansion & 10-Acre Development Project (SCH No. 2016091024) and Ground Lease Project
Dear Public Records Act Coordinator:
We are writing on behalf of Coalition for Responsible Equitable Economic Development (“CREED LA”) to request immediate access to all public records referring or related to the Citadel Outlets Expansion & 10-Acre Development Project (SCH No. 2016091024) proposed by Citadel Holdings Group, LLC (“Citadel Project”), and the Ground Lease Agreement and Master Lease between the City of Commerce and Silverado Management and Holding Company (“Ground Lease Project”), since the date of our last request on June 5, 2019.
This request for records includes, but is not limited to, any and all materials, applications, correspondence, memos, notes, analysis, electronic mail messages, attachments to electronic mail messages, files, maps, charts, or any other documents concerning any project-related activity.
This request specifically includes, but is not limited to, all records related to:
- Any and all new and/or proposed permits requested by the Applicant(s), and/or any other party, related to the Citadel Project and/or the Ground Lease Project since the City’s June 18, 2019 approval of the Ground Lease and July 2, 2019 approval of the Citadel Outlets Project;
- Any and all new and/or proposed permits issued by the City related to the Citadel Project and/or the Ground Lease Project since the City’s June 18, 2019 approval of the Ground Lease and July 2, 2019 approval of the Citadel Outlets Project; and
- Any and all project-related activity on either the Citadel Outlets Project or the Ground Lease Project since the City’s June 18, 2019 approval of the Ground Lease and July 2, 2019 approval of the Citadel Outlets Project.
This request is made pursuant to the California Public Records Act. (Government Code §§ 6250, et seq.) This request is also made pursuant to Article I, section 3(b) of the California Constitution, which provides a Constitutional right of access to information concerning the conduct of government. Article I, section 3(b) provides that any statutory right to information shall be broadly construed to provide the greatest access to government information and further requires that any statute that limits the right of access to information shall be narrowly construed.
We request immediate access to review the above documents pursuant to section 6253(a) of the Public Records Act, which requires public records to be “open to inspection at all times during the office hours of the state or local agency” and provides that “every person has a right to inspect any public record.” Gov. Code § 6253(a). Therefore, the ten-day response period applicable to a “request for a copy of records” under Section 6253(c) does not apply to this request.
Pursuant to Government Code Section 6253.9, if the requested documents are in electronic format and are 10 MB or less (or can be easily broken into sections of 10 MB or less), please email them to me as attachments.
